Q: I was in a car accident and have been told that the other driver doesn't have any insurance. Could I still have a case?
A: You may still be able to pursue a claim if you are hurt in a car crash even if the driver at fault does not have insurance. If the driver at fault was driving someone else's car, the owner of the car may have insurance and could be responsible. If neither the driver nor owner have insurance, you can still pursue a claim if you have uninsured motorist coverage on your car or there is uninsured motorist coverage on the car you were in when the crash occurred. A claim can always be brought against the driver or owner at fault, even without insurance, however it is very difficult to actually collect on a judgment.
