Aggressive Driving Causes Palm Beach Car Crashes

Most of us have experienced the wrath of an aggressive driver. Maybe someone followed you too closely, cut you off, or yelled obscenities at you as they were passing. These types of aggressive driving behaviors cause numerous Palm Beach car wrecks each year. We can all agree that those aggressive drivers are extremely dangerous, and that they look ridiculous as well. But have you ever stepped back and examined yourself? Is there a chance that you may exhibit some aggressive driving behaviors?

Whether you believe you are an aggressive driver or not, here are some tips to keep you from being tempted to drive aggressively.

• Give your full concentration to the road. Don't let yourself become distracted by phone calls or text messages.
• Give yourself adequate time to get where you're going. If you know your drive usually takes you twenty minutes, give yourself twenty-five. If you are running late you may be more tempted to swerve in and out of lanes, speed, or run red lights.
• Obey signs and signals. Pay attention to speed limits and signs. Watch for school zones, crosswalks, and objects in the road, such as road crews, mail delivery vehicles, and school buses.
• Don't take other driver's' actions personally. Sometimes people cut you off by accident or look at you because they're curious. Don't take their actions personally or try to "teach them a lesson."
• Relax and enjoy your drive. Try to enjoy your time in the car. When you are driving, you cannot be expected to do anything else, so sit back, put on some of your favorite music, and enjoy your moment to relax.

If you have been seriously injured in a Florida automobile accident, the Palm Beach car crash lawyers at Fetterman and Associates are here to help. Contact our office today for a free, no obligation consultation.

The High Cost of Palm Beach Nursing Home Falls

Palm Beach nursing home falls occur more frequently than most people would imagine. They are usually preventable, but the necessary steps to prevent these dangerous falls are often not taken. These falls cause extreme pain and suffering, and older adults cannot heal as quickly. This fragility results in numerous deaths from nursing home falls each year.

According to the Centers for Disease Control and Prevention (CDC):
• One in three adults, age 65 and older, falls each year.
• Of those who fall, 20 percent to 30 percent suffer moderate to severe injuries. These injuries make it difficult for them to get around or live independently. These injuries can also shorten their lives.
• Fall related injuries are the most common reason for hospitalization of older adults. In fact, injuries from falls account for five times more hospitalizations than any other injuries.

These falls cost nearly $20,000 per person and account for $19 billion in healthcare costs per year. These costs include hospital and nursing home care, rehabilitation, medical equipment, prescription drugs, home rearrangement, and insurance processing.

Fall-related Injuries
• The most common fall-related injuries are traumatic brain injuries (TBI), and injuries to the hips, legs, and feet. These injuries account for 78 percent of fatalities.
• Nursing home falls that cause injuries to internal organs contribute to 28 percent of fatalities.
• Fractures are the most common and most costly type of nonfatal inqury.
• Approximately one-third of nursing home falls result in a fracture; fractures, however, account for about 61 percent of fall related costs.

Nursing homes need to implement procedures to prevent these dangerous falls, and should be held accountable for allowing so many falls to happen on their premises. If your loved one has suffered a devastating fall due to a nursing home's neglectful failure to ensure a safe environment, you need to speak with a Palm Beach nursing home neglect attorney today. Contact Fetterman & Associates at 1-800-LAW IN FL (529-4635) for a free consultation regarding your Palm Beach nursing home abuse case.

Florida Car Crash Involving Stolen Car and Bank Fraud Leaves Five Dead

On July 8, five people, fleeing a bank in a stolen car, were killed in a fiery Florida car crash near Zoo Miami.

At approximately 12:45 p.m., police were notified of fraudulent activity at a Miami-Dade bank near 137th Avenue and Southwest 152nd Street. When an officer attempted to stop a silver Infiniti that was driving away from the bank, it immediately made a U-turn and fled at a high rate of speed.

The officer lost sight of the Infiniti and radioed in the car's description and last known direction of travel.

Unfortunately, it did not take long for the authorities to catch up with the it.

As the car sped down 152nd Street, it ran a red light at 119th Avenue, crashed through a fence, hit a tree, and burst into flames.

The Miami-Dade police and fire rescue attempted to save the occupants in the car, but were unsuccessful. Four occupants had already perished when the Miami-Dade police and fire rescue arrived. The legs of the last occupant were trapped inside the vehicle, preventing rescuers from freeing her. Surgeons from the Ryder Trauma Center were called in to attempt a field amputation, but the victim died before the surgeons arrived.

The occupants, who appear to have been four men and one woman, all perished at the scene. Due to the severity of the burns, the bodies have not yet been identified.

The wreck is still under investigation. Investigators have not stated what kind of bank fraud was committed, nor at which bank the alleged fraud occurred.

Police ask anyone with information regarding this horrific Florida car accident to contact Crime Stoppers at 305-471-TIPS (8477) or 866-471-8477.

Be a Good Friend—Prevent a Palm Beach Drunk Driving Accident

Many of us have been in a situation in which a friend who was too drunk to drive still insisted that they were okay to make it home. It can be a very uncomfortable situation, but the outcome can be much, much worse if your friend attempts to drive home and is involved in a Palm Beach car crash in which they injure themselves, or worse, another innocent person.

As a friend, it is your responsibility to make sure your loved ones are not a threat to themselves or anyone else on the road. You need to ensure that they get home safely and do not have access to their keys. In order to keep an intoxicated friend from getting behind the wheel, you might try the following:

• Pull the person aside and quietly explain that you believe they have had too much to drink.
• Be calm, do not raise your voice, and do not draw attention to the situation. Try not to embarrass them or be confrontational.
• If it is one of your good friends, tell them that if they insist on driving, you will not be riding with them and will seek another way home instead.
• If it is someone you do not know well, speak with their friends and have them attempt to convince them to hand over their keys.
• If all else fails, try to take their keys when they are distracted. When they are unable to find them, they will have to find another
way home.

It is your job to be responsible, even when your loved one isn't. For information on how to drink responsibly, read our article entitled Prevent a Palm Beach Drunk Driving Accident by Drinking Responsibly.

If you or a loved one have been involved in a Palm Beach car wreck caused by a drunk driver, contact our office today.
Palm Beach County Traffic Deaths Decrease Significantly

The numbers in a recently released study are uplifting. The number of Palm Beach car accidents that result in death decreased nearly 30 percent from 2008 to 2009.

According to a report issued by the Florida Department of Highway Safety and Motor Vehicles and the Florida Department of Transportation, traffic fatalities in Palm Beach County dropped from 198 in 2008 to 151 in 2009.

Police are attributing the decrease to increased enforcement efforts and educational safety talks.

The decline in deaths is being seen not only in Palm Beach County, but throughout the entire state of Florida. The study also noted that Florida teen car crash deaths and Florida motorcycle crash deaths have seen a steep decline.

Motorcycle deaths, which have been rising steadily since 1996, declined statewide by 24 percent in 2009. It is believed that the decline may be attributed to a 2008 law, which requires a training course for anyone wishing to obtain a motorcycle license.

We at Fetterman & Associates are glad to see that Florida drivers are being safer on the road. Accidents still happen, however, and unfortunately, innocent lives are still lost every day. If someone you love has been killed in a Palm Beach car crash caused by a negligent driver, contact our office today.
Elderly Boca Raton Couple Killed in Deadly West Palm Beach Car Crash

An elderly couple suffered fatal injuries when the car they were riding in was involved in a deadly Palm Beach car crash.

A little before 7 a.m. on June 26, Lunda Boliere was driving her 2004 Toyota Avalon north on I-95. Boliere, who was the caregiver for passengers Diana S. Einhorn, 78, and Sidney Norman Einhorn, 81, was driving the Einhorns, their granddaughter Naomi Graham, 12, of Warr Acres OK, and Naomi’s mother Elise Sharon Graham, 52, also of Warr Acres to Palm Beach International Airport.

As Boliere was driving, she was cut off by an unknown car. Boliere lost control of the vehicle, and crossed from the middle lane over to the entrance ramp to 10th Avenue North. The car then vaulted over the ramp, struck the adjacent concrete wall, and flew into the air before it came to rest on its roof on the grass shoulder.

Diana Einhorn was thrown from the car during the accident. Diana and her husband, Sidney Einhorn, both of Boca Raton, were pronounced dead at the scene.

Lunda Boliere, Naomi Graham and Elise Sharon Graham were all transported to St. Mary's Medical Center where they were listed in critical condition.

The Highway Patrol is looking for the car that cut off the 2004 Toyota Avalon, but troopers do not yet have a description. Anyone with information about the Palm Beach car accident is asked to call Cpl. Anibal Monroig at 561-357-4000.

It is heartbreaking to hear of such a tragic Florida car crash. Our thoughts are with all who were involved in this devastating accident and our condolences are with the friends and families of Diana and Sidney Einhorn.
Woman Causes Florida Car Crash, Then is Rescued by Person She Hit

On June 22, a Miami Springs woman caused a Florida car crash that sent her car careening into a canal. As she frantically tried to escape from her sinking car, she was rescued by the man whom she had struck just moments earlier.

On her way home from her daughter’s house, Carmen Tapp, 67, was driving her Ford Focus south on Flamingo Circle. As she attempted to cross the median of Westward Drive, she struck a 2008 Mitsubishi. The force of the crash caused her car to continue traveling straight into a canal.

Disoriented and confused, Tapp struggled to escape from her sinking car. Unable to open the door against the water pressure, and with water rushing in at her feet, she attempted unsuccessfully to break a window.

Twenty-seven-year-old Jason Cruz, whom she has just struck, raced from his car into the canal. With the help of another bystander, Cruz was able to get the car rolled up onto the side of the canal, thereby getting the passenger side out of the water. Tapp was then able to get to the passenger side of her car, where Cruz helped her escape.

When asked about his heroic reaction, Cruz stated, “When she hit me I was in shock and I look over and see the back end of her car going into the canal. I took off my shoes and shirt and just jumped in. I didn't have time to think about it.”

Tapp and Cruz both emerged uninjured.

This is quite an amazing story, one that could have turned out very differently. The Palm Beach accident attorneys at Fetterman & Associates would like to commend Mr. Cruz for his bravery and selflessness in this frightening Florida car accident. Our thoughts are with Ms. Tapp and Mr. Cruz.
Deadly Boynton Beach, Florida Car Crash Kills One and Injures Five

A Boynton Beach car crash involving a van full of special-needs adults leaves one dead and at least five wounded.

On June 23, a Gayle Transportation van which had been transporting special-needs adults from the Boca Habilitation Center on Boca Rio Rd, crashed into the Boynton Beach Boulevard exit sign on northbound I-95.

At approximately 3:15 pm, Shanee Davila, 18, of Lake Worth, was driving her Toyota Scion northbound on I-95 in the lane adjacent to the HOV lane. Davila attempted to merge into the HOV lane, but over-corrected when she noticed another car in the lane. She swerved across all traffic lanes and struck the Gayle Transportation van, which was traveling in the outermost lane of the highway. This sent the van onto the shoulder, where it collided with the pole of the Boynton Beach Boulevard exit sign.

The injuries sustained by passengers in the van were devastating. 3 passengers, Regindia Palmore, 36; Anthony Laster, 26; and Gracita Clairvoyant, 33, were seriously injured and Rachelle Thaddies, 54, was killed. The driver of the van, Gary Anthony Francis, 49, of Riviera Beach, had to be extricated from the van along with two other passengers. He was transported to the hospital, but his injuries were less serious, and he is listed in stable condition.

The driver of the Toyota Scion, Shanee Davila, was transported to the hospital with non-life-threatening injuries.

It is important to be aware of everything around you and not to allow yourself to be distracted when you are driving.
Necessary Preparation for a Palm Beach Car Crash into a Body of Water

The beautiful bodies of water that wind under and along many of Florida’s roadways can also be very dangerous. A Florida auto accident in which a car is thrown into a body of water can be catastrophic, especially if you have not prepared yourself for the possibility of being involved in a car wreck that involves water submersion.

Many people believe that being involved in a water crash guarantees their doom, but this is not true. A Palm Beach water crash is usually survivable. If you have the misfortune of being involved in one, the most important thing to remember is to be calm. Although this may seem nearly impossible, it is vital to your survival.

Your first line of defense in a Florida auto accident is a seat belt. In the event of a water crash, your seat belt can keep you from hitting your head and getting knocked out. After all, you can’t escape from a vehicle if you are unconscious.

In preparation for a water crash, you should have the necessary safety devices on hand. Be sure to have a spring loaded center punch or escape hammer in your car. Make certain it is safely secured but still within reach. It is not recommended to keep these items under your seat or resting in a door compartment, as they could be thrown through the air during a collision and might cause severe injuries. You can purchase these devices from a hardware store, or online for about $10–$15 each. You may also wish to purchase a seat belt cutter, although this device should not be necessary, as seat belts are designed for quick release.

The last step in preparation for a water accident is to read our article How to Survive a Florida Water Car Crash. Share this information with your friends and family to ensure their safety in any Florida car accident involving water.

Pedestrian Killed in West Palm Beach Hit-and-Run

A devastating West Palm Beach pedestrian fatality occurred in the early morning of Saturday, June 12, when a man was struck and killed in a West Palm Beach hit-and-run.

Samuel Castro, 24, of Greenacres, was crossing in the 6500 block Lake Worth Road at approximately 2:40 a.m. when he was struck by an SUV.
Safety Tips for Your Motorcycle Enjoyment

As the weather warms up, more and more people decide to take a joy ride on their motorcycles. While motorcycle riding is a fun thing to do, it is also dangerous if you don’t take certain safety precautions. Follow these safety tips to ensure your Florida motorcycle ride really is joyful.

Always wear a helmet. Helmets are one of the most important pieces of protective gear you can wear. In fact, according to the National Highway Traffic Safety Administration (NHTSA), helmets are estimated to be 37% effective in preventing fatal injuries to motorcycle riders.

Do not speed. Nearly 35% of all motorcycle riders involved in fatal crashes are proven to have been speeding.

Do not drink and drive. Not only is it extremely dangerous, it is also illegal. Approximately 30% of all fatally injured motorcycle riders have BAC levels of .08 g/dL or higher. Also, nearly 43% of motorcyclists who die in single vehicle crashes have BAC levels of .08 g/dL or higher.

Drive defensively. 47% of all motorcycles involved in fatal crashes collide with another vehicle. Do not tailgate or allow anyone else to follow you too closely.

Be aware of your surroundings. Do not ride in cars’ blind spots. Watch for other vehicles and pedestrians at intersections. Also be aware of other vehicles that may be turning left as you are passing.

Obtain a valid motorcycle operator’s license. One out of every four motorcyclists involved in fatal crashes do not have a valid license. Maintaining a valid license ensures you continue your motorcycle safety education so that you may protect yourself on the road.

Pool Safety Tips from Child Injury Lawyers at Fetterman & Associates

When the weather warms up, Florida families head outside. A favorite outdoor activity is swimming. Swimming can be an enjoyable pastime to participate in with friends and family; however, please keep in mind that there are many dangers that come along with this fun activity.

In Florida, drowning is the largest cause of death in children under 5. Whether you happen to be swimming at the beach, a pool in your neighborhood or even in your very own back yard, there are many safety precautions you should keep in mind. Please keep your children and family safe and healthy by following these Florida pool safety tips.

When you are near water, keep a close eye on your children. Know where they are at all times. Remember, just because they have had swimming lessons does not mean it is safe for them to swim unattended.

If your child is not proficient swimmer, have them wear a life vest. Inflatable devices, such as inner tubes and arm bands, are a wonderful learning tool, but they should only be used under direct supervision.

Teach your children about the dangers of entrapment. Do not allow them to play or sit on drains. Additionally, if you own a pool, install anti-entrapment drain covers to prevent entrapment injuries.

Remember, the best prevention for drowning is a vigilant parent. Most swimming injuries can be prevented by being watchful and observant of your children at all times, as well as taking all necessary safety measures.

If you or a child you love has sustained a Florida pool injury, please contact a Palm Beach injury lawyer at Fetterman & Associates today.
Is a Nursing Home the Right Choice for Your Loved One?

If your loved one is becoming forgetful, frail, or depressed, you may think they need to be admitted to a Florida skilled nursing facility. However, you may be able to find support within the community that can help them with their daily living for months, or even years more. If you are considering a Palm Beach nursing home for your loved one, make sure you do the following first:

Arrange an evaluation – Your loved one should be evaluated by a geriatrician. They will perform a geriatric assessment to evaluate his or her physical and mental status. They will then offer you options based upon their findings.

Make your own assessments – Observe the things your loved one is having trouble doing, as well as those activities they can accomplish independently. Speak with other friends and family members regarding their concerns as well.

Examine the options that your community offers – Many communities offer a “Meals on Wheels” program to deliver food, or adult daycare options, which provide social interaction with others. Another option may be an assisted living facility, which offers limited care, but is not as involved as a skilled nursing facility.

Consider hiring a professional care manager – A professional care manager can arrange for companions to help with your loved one’s care. For example, they can stop in to visit, help with grocery shopping, or assist with household chores. This way, your loved one can stay living in the comfort of their own home while still receiving assistance with small tasks and chores.

No matter what your decision may be, it is never an easy one. Be sure to consult with others to help you through this difficult decision.

If your loved one is already living in a Florida nursing home and you believe they may be suffering from Florida nursing home abuse, please contact our offices at 1-800-LAW IN FL (529-4635) today.
McNeil Launches a Massive Recall on Children's Medications

On April 30, 2010, McNeil Consumer Healthcare announced a voluntary recall of certain OTC infants’ and children’s medications. This recall includes liquid Tylenol, Motrin, Zyrtec, and Benadryl.

McNeil Consumer Healthcare is initiating this recall because some of these products may not meet required quality standards. No adverse medical affects have been reported; however, as a precautionary measure, parents and caregivers should not administer these products to their children. Some of the products included in the recall may contain a higher concentration of active ingredients than is specified, others may contain inactive ingredients that may not meet internal testing requirements, and others may contain tiny particles. While the potential for serious medical issues is unlikely, the company advises consumers who have purchased these recalled products to discontinue use.

There are many generic versions of these products on the market. These generic versions are not affected by the recall and are considered safe to use. If you have any questions concerning the generic versions of these products, please consult with doctor or pharmacist.

For more information regarding this recall, including the specific products involved, please visit the McNeil product recall site.

The Palm Beach injury attorneys at Fetterman and Associates take drug and manufacturing errors very seriously.
Have you been involved in a Florida Car Accident?

If you have been involved in a Palm Beach Car Accident, you need to protect your rights. Here are the dos and don’ts following a Florida car accident.

DON’T leave the scene of the accident. Wait until the police have arrived and have given you permission to leave.

DO call the police. A police report is vital in your case, as it will help to determine who is responsible and how the accident occurred. If you do not file a police report, it is your word against the other driver’s.

DON’T admit responsibility - even if you think the accident may have been your fault. There may have been external factors that contributed to the accident, such as excessive speed of the other driver, the influence of drugs or alcohol or unsafe road conditions.

DO take photos of the accident. They may prove to be extremely helpful in your Palm Beach auto accident case.

DON’T sign any paperwork given to you by the insurance companies without first talking with a lawyer. Do not speak to anyone from the other person’s insurance company, as this statement may be used against you. Do not agree to a settlement before seeking counsel from an attorney.

DO CONTACT FETTERMAN & ASSOCIATES at 1-800-LAW IN FL (529-4635) for a FREE consultation with one of our Palm Beach auto accident attorneys.
How Do You Recognize Malpractice in a Florida Nursing Home?

Do you have a family member living in a Florida nursing home? If so, it can be assumed that you made this decision believing that your loved one was going to receive the best possible care. Unfortunately, this isn’t always the case.

Many nursing home residents find themselves abused at the hands of employees whether it’s in the form of physical abuse, emotional abuse and even neglect. A lot of times, these incidences result from the for-profit institutions' priority on their bottom line.

With that being said, it’s important to recognize signs of nursing home abuse. Several examples of Florida nursing home malpractice include failure to help residents with personal hygiene, failure to provide acceptable medical care, and failure to provide a safe environment, to name a few. You may also want to look for symptoms such as bedsores, bruises and unexplained weight loss that would indicate nursing home neglect.

If you discover that your loved one is a victim of nursing home malpractice, there are things you can do to hold the institution responsible. It is imperative that you seek professional legal advice. An experienced Palm Beach nursing home neglect attorney can help you hold the nursing home accountable and possibly receive financial compensation.

If your loved one has been abused while staying in a nursing home, you should contact one of our experienced Palm Beach nursing home neglect lawyers at Fetterman & Associates at (561) 845-2510 or (800) LAW IN FL (529-4635).

Florida House Ready to Address Wrongful Death Statute of Limitations

Are you familiar with the term, “statute of limitations?” Simply, statute of limitations is basically a window for filing a lawsuit. The Florida House is now considering ending the statute of limitations in wrongful death lawsuits involving civil cases.

This decision could drastically affect Jeffrey Klee’s family, whose body was dumped just off of Riverside Park in Coral Springs in 1977. Klee’s friend admitted that following an argument, he pushed a van, with Klee’s body in it, into a canal. Unfortunately, the admission occurred well after the timeframe that the family could seek justice and file a wrongful death suit.

That could all change if the Florida House passes HB1. Klee’s family would be able to go after the suspect and seek damages. This bill could allow other families to file civil suits in cold cases such as Klee’s.

“This bill will give some families at least a little bit of satisfaction that something can be done,”
Klee’s mother, Flossie Klee said.

If you are considering filing a wrongful death suit, you should contact one of our experienced Palm Beach wrongful death lawyers at (561) 845-2510 or (800) LAW IN FL (529-4635).
Toyota Recalls Continue – What Does This Mean For Florida Drivers?

Toyota Motor Corp. halted the sales of the Lexus GX 460, not long after Consumer Reports announced that the SUV had an unusually high risk of rollovers during turns.

“We are taking the situation with the GX 460 very seriously and are determined to identify and correct the issue Consumer Reports identified,” Toyota said in a statement.

Consumer Reports stated that when the SUV was “pushed to its limits on a handling course on CR’s test track, the rear of the GX CR purchased slid out until the vehicle was almost sideways before the electronic stability control system was able to regain control.”

A week after suspending the sale of the GX 460, Toyota decided to recall 13,000 of these vehicles. Toyota engineers had replicated the handling flaw that Consumer Reports found, by conducting tests on all Toyota and Lexus-brand SUVs. The flaw was only discovered in the GX 460 and Land Cruiser Prado models. The Land Cruisers were only recalled in countries with left-hand drive.

Lexus group vice president, Mark Templin, said that Lexus and the dealers have acted promptly to resolve the situation.

This Lexus recall follows a previous one made by the company, involving millions of Toyota vehicles. These design defects have left many people wondering what their chances are of being injured in a Florida car accident caused by a Toyota vehicle.

If you have a GX 460, you should contact a local Florida dealership for more information. You can also visit the website, http://www.toyotarecall.org/dealers/florida/, to look up a dealership in your area that can assist you.
Are Florida Drivers Really Using Their Cell Phones While Driving?

It’s common to pull up to another car on the Florida roadways to see the other driver talking on his or her cell phone. Maybe you are one of these drivers. You will be surprised to learn how many people are guilty of talking on a cell phone while driving.

The Insurance Institute for Highway Safety recently surveyed 1,219 drivers, 18 and older, regarding their driving and cell phone habits. The results were alarming.

The survey showed that approximately 40 percent of drivers admitted to talking on their phones a few times each week. Nineteen percent said that they drive and talk daily. Fortunately, thirty-five percent of drivers said they never talk and drive.

So, what does this information mean? Keeping in mind that each driver spends an average of one hour a day behind the wheel and approximately 4 minutes of this time is used to talk on the phone, it means that approximately 7 percent of drive time involves a distraction.

This fact becomes even more concerning when you take into account that drivers sometimes take their eyes off the road to either answer the phone or call someone. This driving behavior can put you and your family at a greater risk of being involved in a serious Florida auto accident.

If you or someone you know has been injured in a car accident, you should contact one of our experienced Palm Beach car accident lawyers at Fetterman & Associates – The Law Team at (561) 845-2510 or (800) LAW IN FL (529-4635).

Florida Nursing Home Under Investigation For Abuse

According to police, a 76-year-old woman, who was a resident at the Ridgecrest Nursing and Rehabilitation Center, suffered two broken legs and a broken shoulder after a fall. The police report indicates that the nursing home resident was injured when she fell from her bed. The woman was placed back in her bed where she was in pain for several hours.

What’s alarming about this story is that emergency crews were allegedly not called to the scene until nearly 12 hours after the woman was injured. Rescue crews transported the victim to Halifax Health Medical Center in Daytona Beach.

The Florida Agency for Health Care Administration is investigating this nursing home facility. The agency started its investigation on February 24, due to a complaint. This investigation is not the first for the Ridgecrest Nursing and Rehabilitation Center. It was also investigated on Dec. 2, 2009 for complaints of sanitary deficiency.

Florida nursing home abuse is serious and those who commit these awful crimes should be held liable.
What Not To Do After a Palm Beach Slip and Fall Accident

Imagine finding yourself in the hospital after a Florida slip and fall accident. Believe it or not, slip and fall accidents are more common than you think. They can also be more serious than you might realize, leaving you to face a mountain of medical bills and unable to work, facing a potential loss of wages.

So, what should you do and not do following a slip and fall accident? The first thing you should do is realize that the other parties involved are probably not on your side. Keep in mind that the insurance adjuster, who will probably call you, works for the insurance company and has his or her employer’s best interest in mind. You should contact a Palm Beach slip and fall accident attorney immediately to determine if you have a case.

Whatever you do, do not admit fault to the accident. An insurance adjuster will likely ask you for a statement. The adjuster is probably looking for a reason to deny your claim.

Also, be careful what you say while giving your statement. Again, do not accept blame and always require a copy of any statement that you provide. The success of your case may depend on it.

If you or someone you know has been injured in a Palm Beach slip and fall accident, you should contact an experienced Palm Beach accident attorney at Fetterman & Associates – The Law Team at (561) 845-2510 or (800) LAW IN FL (529-4635).
Bed Sores Caused by Florida Nursing Home Neglect Can be Fatal

Many elderly people are admitted into Florida nursing homes daily. Family members admit them under the assumption that they are going to receive quality care. However, that is not always the case. In some situations family members discover that their loved ones are being neglected at the hands of those they originally trusted to care for them.

Are you familiar with bed sores? You may have heard the term but may not know exactly what they are or what causes them. A bed sore is also referred to as a pressure sore and usually develops when a person remains in the same position for a lengthy period of time. They can often be found in the hip, lower back and heel regions.

Unfortunately, nursing homes residents are vulnerable to developing bed sores in Florida. Often, nursing home staff fails to rotate and move patients enough to avoid bed sores.

No one wants to learn that their family members are being neglected and you may not think that bed sores are all that serious. However, keep in mind that not only are bed sores serious, they can also be deadly.

If you or someone you know has been a victim of neglect or abuse in a Florida nursing home, you should contact an experienced Palm Beach nursing home abuse attorney at Fetterman & Associates at (561) 845-2510 or (800) LAW IN FL (529-4635).

What You Can Do If Your Loved One Is Abused In A Florida Nursing Home

Do you or someone you know have a loved on in a Florida nursing home? If so, you placed them there with the assumption that they were going to receive the best possible care. Unfortunately, that is not always the case and people are abused in Florida nursing homes.

As unbelievable as it sounds, many elderly suffer physical, sexual and emotional abuse at the hands of nursing home employees. This scenario leaves family members wondering what to do. Fortunately, there are several things you can do.

You need to speak with someone who is in charge. Do not settle with talking with low level staff.

Submit your concerns in writing. This will notify the nursing home that you are serious about your concerns. Request their response in writing. You need to also make sure you follow through with any requests that you make.

Also, plan on making more visits and not always at the same time. You do not want the nursing home staff to clean up their “act” when they know you are coming.

Lastly, it is imperative that you seek legal counsel. A Florida nursing home abuse attorney who specializes in nursing home neglect and abuse cases will be able to help you resolve your issues.

If you or someone you know has a loved one who is a victim of nursing home abuse in Palm Beach County, Martin County or Port St. Lucie County, you should contact an experienced Palm Beach nursing home abuse lawyer at Fetterman & Associates at (561) 845-2510 or (800) LAW IN FL (529-4635).

You Can Prevent Injury in a Palm Beach Auto Accident

When you load your family into the car, you are probably not thinking about your chances of being hurt in a Palm Beach car accident, but unfortunately, crashes occur on a daily basis. In 2008, an average of 665 traffic accidents occurred every day in Florida. It has also been estimated that over 41,000 people are killed in the United States in motor vehicle accidents.

You cannot always prevent an accident from happening, but you can help avoid serious injuries and death. For example, when child safety seats are properly installed and used, they can lower the risk of death by 47 to 54 percent for toddlers (ages 1 to 4) and by 70 percent for infants.

Seat belts have been found to reduce severe injury to the head, chest and extremities by 50 to 83 percent. Seat belt usage is also believed to reduce deaths anywhere from 45 to 60 percent. Over two-thirds of people in the United States buckle up, but ideally, this number should be significantly higher.

You can also reduce your risk of injury in a Florida auto accident by avoiding driving after you have had one too many drinks. Drunk driving accidents are to blame for countless deaths in Florida each year.

If you have been hurt in a car crash in Palm Beach County, St. Lucie County or Martin County, contact a Palm Beach car accident attorney at our office at 1-800-LAW IN FL (529-4635).
Trucker Texting Ban Could Lower the Amount of Florida Truck Accidents

Up to this point, commercial truckers and bus drivers have been allowed to text and drive in Florida. However, things have changed.

The federal government has recently banned bus drivers and truckers from texting while driving. These new restrictions apply to interstate truckers and operators of vehicles carrying at least eight passengers. Truckers and bus drivers who violate this ban could be fined up to $2,750. It will be interesting to see the impact this ban will have on the amount of Florida truck accidents.

"This helps to establish a uniform safe application of texting bans around the country. This is a high-risk behavior. Drivers who text take their eyes off the road for (an average of) 4.6 seconds. In this congested environment, we cannot allow these conditions to continue," said Anne Ferro, head of the Federal Motor Carrier Safety Administration.

There have been numerous studies into the dangers of cell phones and other driver distractions. One study, found that taking your eyes of the road for a mere three seconds significantly impacts your probability of being involved in a collision. According to Ferro, texting takes even longer. For truck drivers, they have to be alert to dangers at all times, as it takes quite a bit longer to stop these massive vehicles.

If you have been hurt in a truck accident in Palm Beach County, St. Lucie County or Martin County, contact a Palm Beach truck accident attorney at our office at 1-800-LAW IN FL (529-4635).

A Palm Beach Car Accident Can Lead to a "Talk and Die" Head Injury

Imagine learning that you fractured your skull and didn’t know it. Unfortunately, many people fracture their skull in a Florida car accident and are unaware of the extent of their injury until later. Medical experts refer to this situation as the “talk and die” syndrome.

This condition is very serious. When a person suffers a skull fracture he or she runs the risk of having bleeding or swelling in the brain, which can lead to major complications and death. The frightening part of it is the fact that the complications may arise late after the accident.

As you know, a head injury can be a result of many kinds of accidents, including a fall at work or from a Palm Beach car accident. It may even be caused by negligence on the part of someone else. You may appear fine at first, but again, the complications might arise later.

If you have injured your head in an accident, no matter how minor it appears, you should seek medical attention.

Also, the impact that a serious head injury can have on your family, as well as your job, can be drastic. You may be left with tough questions, such as who is going to pay your medical bills or who will care for your family?

If you or someone you know has been injured in a Palm Beach County car accident, you should contact an experienced Palm Beach car accident lawyer at Fetterman & Associates – The Law Team at (561) 845-2510 or (800) LAW IN FL (529-4635).

For more information on this topic, read the article, A “Minor” Bump On The Head In A Car Accident Could Actually Be Serious.

Young Lives Are Lost in Florida Car Accidents

The national leading cause of death among children and young adults is car accidents. In Florida, auto accidents claim countless lives and many of them are young victims. More children and young adults die each year from motor vehicle related-injuries than by any other means in the United States.

If you are a parent then you need to be made aware of the risks that your child faces. Car accidents are a huge problem in America for children, including Florida.

The exact reasons may not be clear but we can all agree that children on bikes and scooters are in danger of being hit by a car at anytime. A tragic story of a recent accident in Edgewater, which left a 10-year-old girl in critical condition, is a prime example of the seriousness of motor vehicle accidents.

If you or someone you know has been injured in a Palm Beach County car accident, you should contact an experienced Palm Beach car accident lawyer at Fetterman & Associates at (561) 845-2510 or (800) LAW IN FL (529-4635).

Read the article, Are Florida Car Accidents the Leading Cause of Child Death, for more information on this topic.
How Palm Beach Toyota Dealerships are Responding to Accelerator Pedal Recall

If you own one of the Toyota vehicles involved in a nationwide recall, you probably have a lot of questions and a lot of concerns. The massive recall was initiated after a problem with the accelerator pedal was identified. This Toyota recall has left many residents in Palm Beach scrambling to find out more information.

The auto manufacturer made a bold move recently when it halted sales and production of many of its vehicles. Jim Lentz, president of Toyota Motor Sales, emphasized during a conference call that Toyota wants to place the safety of its customers first.

There have been numerous reports of accelerator pedals becoming stuck. In Florida, this defect could become a deadly problem for motorists. A serious Palm Beach car accident could result from this defective auto part.

Apparently, as the pedal becomes worn it may not operate smoothly and could become jammed. Engineers discovered that there was an issue with a friction device in the assembly, which is supposed to give the appropriate pedal “feel” by adding resistance.

Many Palm Beach County Toyota dealerships have been fielding calls inquiring about the defective pedals. However, the response among Florida drivers has been varied. Glenn Grosso, area vice president for Penske Automotive Group, which owns Royal Palm Toyota and Palm Beach Toyota, stated that “some people are finding this extremely urgent, other people not so much.”

According to Grosso, his dealerships are conducting as many as 50 to 60 vehicle inspections every day. He said that they haven’t found a sticky pedal yet.

If your Toyota vehicle has been involved in this recall, contact your local Florida Toyota dealer or call the manufacturer at (800) 331-4331.

Man Lying in Roadway Causes Deadly Palm Beach Car Accident

Early Sunday morning, a man lying in the road was struck and killed, and left for dead in a Palm Beach hit-and-run car accident.

At around 4:30 a.m., twenty-four-year-old Darrell Jean Renaud was lying in the street, just south of Roebuck Road. A Toyota Sedan approached and struck the man, and then fled the scene.

It is not known why Jean Renaud was lying in the road, but county records show that he has been arrested for disorderly conduct and public intoxication twice in the past two years.

Jean Renald died at the scene.

Investigators were searching for the driver of the vehicle by early Sunday morning. They have since discovered that the 2005 Toyota sedan was driven by Sheila H. Bolden, 53, of West Palm Beach.

Investigators did not state how Bolden was found or why she did not stop when she struck Jean Renaud in the roadway. As of Monday morning, no charges had been filed against Bolden or her passenger, Martel McCalla of West Palm Beach.

Not giving the road your full attention can have deadly consequences. Our sincere condolences are with the friends and family of Mr. Jean Renaud during this difficult time.

West Palm Beach Woman Hit by Palm Beach County Sheriff's Van

A Palm Beach car crash occurred on the afternoon of Tuesday, July 6, when a Palm Beach County Sheriff's van collided with a motorized scooter driven by a sixty-eight-year-old woman.

At approximately 12:30 p.m., the van, driven by civilian accident investigator, Gerlienus Hester, 44, was traveling eastbound along Westgate Avenue. Sixty-eight-year-old Barbara Guyton, of West Palm Beach, was traveling westbound along the same road on her motorized scooter. Hester, who presumably did not see Guyton, attempted a left turn onto Indian Drive.

The van hit the passing scooter on the left side, forcing it under the Palm Beach County Sheriff's van. Guyton had to be extricated from under the van and was transported to St. Mary's Medical Center in West Palm Beach. She was listed in critical condition later that evening. Thankfully, her condition has since been upgraded to fair.

A police investigation into the incident is still underway.

A Palm Beach motorcycle accident, or in this case, a scooter accident, can often have devastating injuries. The Palm Beach motorcycle crash attorneys at Fetterman & Associates are relieved to hear that Ms. Guyton's condition has been upgraded, and we wish her a quick, full recovery after this unfortunate Palm Beach car wreck.

Fatal Martin County Car Crash Kills 1, Injures 2 Near Palm Beach

In the early morning of July 4, a Cape Canaveral woman was fatally injured in a Florida car crash, near the Palm Beach county line.

Shortly after 5:00 a.m. a 63-year-old woman, whose name has not yet been released, was traveling in the northbound inside lane of Interstate 95. As she was driving north in her 2006 Chevy Impala about four miles south of the Bridge Road exit to Hobe Sound, she struck a 2011 Hyundai Sonata.

The Chevy's front left side struck the front left side of the Hyundai, driven by Kandace Keeling, 23, of Jensen Beach.

The impact pushed Keeling's car onto the shoulder, while the Chevy was forced into another northbound lane. A 2008 Dodge Ram, driven by Patrick Stone, 26, of Vero Beach, then struck the woman's Chevy.

Stone suffered minor injuries in the accident. Keeling was transported to St. Mary's Medical Center in serious condition. The woman in the Chevy died at the scene. Troopers are still attempting to notify her family of the incident.

Florida Highway Patrol investigators suspect that Keeling's car may have been traveling the wrong way at the time of the accident, but this has not yet been confirmed.

The involvement of drugs or alcohol has not been confirmed.

Our condolences are with all who have been affected by this tragic Florida car accident.

This stretch of roadway has proven to be very dangerous. In fact, there have been two fatal accidents in this area in less than a week. We urge each and every driver to be extra vigilant when driving along this stretch of roadway, as you should be any time you drive. Your careful attention when driving could prevent you from being involved in a Palm Beach auto accident.

Three Injured When SUV Lands on Top of Car in Florida Car Crash

Three people have been injured in a Florida car wreck that left an SUV resting on top of a car.

On July 1, at about 6:40 am, Jordan Joseph, 34, of Lake Worth, was driving a 1995 Honda sedan northbound on Interstate 95. While traveling in the center lane near mile marker 90, just north of the Martin County and Palm Beach County lines, one of Joseph's rear tires blew, causing him to lose control.

Nichole Cooler, 20, of Palm City, was driving along the inside lane in her 2002 Kia sport -utility vehicle when the Honda spun into her path.

The SUV struck the side of the Honda, sending both vehicles careening onto the grassy median. The SUV flipped over at least once before coming to rest upon the hood and windshield of the Honda.

Jean Dhaiti, 36, also of Lake Worth, was traveling in the Honda with Joseph. All three people involved were taken Jupiter Medical Center where they were treated for minor injuries.

We at Fetterman & Associates are relieved that this Palm Beach car crash did not turn out to be more serious. We would like to wish all of those involved a quick recovery from their Palm Beach auto accident injuries.

New Information Regarding Palm Beach Polo Club Founder's Fatal Crash

New documents, which were released on June 21, state that John Goodman, founder of Wellington's International Polo Club Palm Beach, was drinking just minutes before his involvement in a fatal Palm Beach car crash last February.

At approximately 1:00 a.m. on February 12, Goodman, 46, flew through a stop sign at approximately 63 mph and crashed into a car driven by Scott Wilson, 23. Wilson’s vehicle rolled into a nearby canal, where he was left to drown, strapped into the driver’s seat of his vehicle.

Cathleen Lewter, who was the bartender at the Player's Club in Wellington that night, stated that Goodman spent over $200 on alcohol throughout the course of the evening, including ten shots of tequila and a vodka tonic.

Wilson’s destination on the early morning of February 12 still has not been determined, as he had already driven past his residence when the accident occurred. Stacey Shore, a friend who was with Goodman throughout the night, said that the Polo Club founder asked her to go with him to get cocaine. Shore declined his offer and Goodman left the Club alone, just moments before the horrific accident.

Hospital tests did not reveal any cocaine in Wilson’s system, but did detect the presence of the painkillers hydrocodone and dihydrocodeine. Wilson stated that these medications were for chronic back pain. Blood tests also revealed that Goodman's blood-alcohol level in the hospital was 0.177, which is more than twice the legal limit for driving in Florida.

This Palm Beach auto-accident case is still under investigation. Our sincere condolences are with all who have been affected by this devastating tragedy.

A Palm City man was fatally injured early Wednesday morning when a Jeep collided with his motorcycle in a deadly Palm City motorcycle crash.

Motorcyclist John Garcia, 63, was traveling along Mapp Road in Palm City when his motorcycle was struck by a Jeep. The Jeep, driven by John K. Holman, 47, failed to yield the right of way to the motorcycle when making a left turn onto Catalina Street. The Jeep then collided with Garcia’s motorcycle.

Although Garcia was wearing a helmet at the time of the accident, he suffered fatal injuries. Garcia was pronounced dead at the scene.

Holman was also traveling with his fifteen-year-old son. Both were wearing seat belts and neither was injured.

When operating a motor vehicle, it is extremely important to watch for motorcyclists.
Intracoastal Waterway Boat Wreck Leaves Palm Beach Deputy Injured

A frightening boat wreck near Jupiter has traumatically injured a Palm Beach County Sheriff’s Office deputy.

At approximately 4:00 p.m. on June 12, 2010, Deputy Cheryl Griffin, 42, was injured in an off-duty accident in her private boat. Griffin was traveling through the Intracoastal Waterway near the 14000 block of Paradise Point Road when she crashed her boat into a dry dock. The impact caused a boat on the lift to fall down onto her twenty-foot vessel.

The accident sent debris flying, pinning Griffin underwater. A bystander, who has not yet been identified, jumped into the water, freed Deputy Griffin, and pulled her to shore with the aid of another neighbor.

Griffin, who was pinned underwater for several minutes, sustained numerous injuries, including broken vertebrae in her neck and a severe infection resulting from bacteria in the Intracoastal water. Doctors were also forced to amputate her arm due to the severity of her injuries.

Deputy Griffin was airlifted to St. Mary’s Medical Center, where she remains in a coma. She is listed in critical but stable condition. Tests indicate that she has normal brain activity, despite having been pinned underwater for some time.

Thirty-eight-year-old Melissa Burdeen, who was a passenger in the boat, sustained minor injuries. She was transported to Jupiter Medical Center, where she was treated and released.

We would like to thank Deputy Griffin for her many years of service, and we wish her a full, speedy recovery.
Nation's Highest Rate of Fatal Car Crashes Occur on Florida's I-95

Recent data released by the National Highway Transportation and Safety Administration reveals that Florida’s Interstate 95 is the most dangerous interstate highway in the United States. Florida’s 382-mile stretch of I-95 is shown to have the highest rate of fatal Florida auto accidents, with 1.73 fatal accidents per mile.

Police presence on the roadways used to be enough to make people slow down and obey traffic laws; however, this is no longer that case.

Florida State Patrol Lt. Alex Annunziato believes that an increase in distracted driving is to blame. He states, “I get people passing me all the time. I see a lot of aggressive driving out there, a lot of lane-changing.”

Often, when he pulls people over, he realizes just how distracted the drivers are. “They're completely startled. You can absolutely see it when my lights come on. They just have this look of, ‘Where did this guy come from?’”

It is not just the usage of cell phones and GPS systems that is creating a big risk on the roadway, but the quantity as well. “I think it's the volume coupled with the level of distraction that's present in the driving environment these days,” Annunziato said. “That really is a recipe for what we've been seeing here.”

As the summer takes full swing, we must be extra vigilant to ensure the safety of ourselves and our loved ones as we travel this dangerous Florida roadway. Always obey traffic laws, do not drive aggressively and restrain from using electronic devices while driving.

If you or a loved one are involved in a Florida car crash on I-95, please contact a Palm Beach car accident attorney at Fetterman & Associates today. We will fight to ensure you receive the compensation you deserve.
Florida Motorcycle Crash Kills West Palm Beach Teen

Reckless motorcycle driving led to the death of a 17-year-old West Palm Beach teen on Saturday, June 5.

On Saturday morning, a teenager from West Palm Beach was tragically killed when his motorcycle collided with a sport utility vehicle. The fatal Florida motorcycle crash occurred around 11:30 a.m. near the 9000 block of Wiles Road in Coral Springs.

Michael Ferraz Lanzoni, 17, was driving his Suzuki motorcycle eastbound on Wiles Road. Andrea Baigorria, 21, was driving a Ford SUV and travelling westbound on Wiles Road. As Biagorria was making a left turn, she was struck on the rear of her SUV by Lanzoni. Lanzoni was ejected upon impact, flying approximately 70 feet through the air before landing in some nearby brush.

Lanzoni was wearing a helmet, but was pronounced dead at the scene.

Several witness accounts state that Lanzoni was travelling at excessive speeds and driving recklessly, swerving in and out of traffic just before the Florida motorcycle accident. A police officer also stated that he witnessed Lanzoni running a red traffic light just moments before the fatal Florida motorcycle crash.

Baigorria was transported to Coral Springs Medical Center where she was treated by medical professionals and released with minor injuries.

Our sincere condolences are with the friends and families of all who have been affected by this tragic Coral Springs accident.
"Top Kill" is Failing to Stop BP Gulf of Mexico Oil Leak

On April 20, an exploratory offshore drilling rig exploded in the Gulf of Mexico, killing 11 and causing a massive oil spill that is devastating the coasts of Louisiana, Mississippi, Alabama, Texas and Florida.

The size of this oil leak was originally estimated to be approximately 1,000 barrels per day; however, this estimate has since been raised to 14,000 to 19,000 barrels per day. Now, one month into this massive oil spill, the seam of oil has emptied as much as 740,000 barrels into the Gulf. At 42 gallons per barrel, this puts the amount of crude oil that has been emptied into the Gulf at over 31 million gallons. This may seem like an incomprehensible amount, but, according to BP, this is only 1.5% of the total oil in the Macondo oil deposit.

This disaster is already the nation’s worst oil spill disaster as well as the worst man-made disaster ever recorded. And, what is just as disturbing, is that there is no immediate end in sight.

BP’s crucial “top kill” effort, which was an effort to plug the deep sea well with heavy drilling mud, has not been successful. The next plan of action is to attempt to contain the flow of oil from a leak with a lower marine riser package (LMRP) cap. The LMRP cap procedure is expected to take four to seven days.

We offer our condolences to all who have been injured by this devastating event. If you or someone you love has been injured by this unfortunate accident, please contact our office today.

Founder of Palm Beach Polo Club Arrested Months After Fatal Crash

John Goodman, 46, founder of Palm Beach International Polo Club, was arrested on May 18 for his involvement in a fatal Wellington car accident. This arrest comes after a 3-month investigation into the crash that resulted in the death of Scott Patrick Wilson, 23, who was a recent University of Central Florida mechanical engineering graduate.

At approximately 1 a.m. on February 12, Goodman, who was driving his Bentley after a night of drinking, ran a stop sign and collided with Wilson’s Hyundai Sonata, sending it rolling into a canal. According to the arrest affidavit, “Goodman fled the scene and left Wilson to drown in the canal, belted in the driver seat of his vehicle.”

Goodman fled the scene and came upon a nearby trailer, where he proceeded to call his girlfriend before calling 911. Phone records show that he called his girlfriend at 1:52 a.m. before calling 911 at 1:55 a.m.

According to the arrest affidavit, when deputies found Goodman, his speech was slurred and he smelled of alcohol. They did not, however, issue a breathalyzer test. Goodman was taken to the Wellington Regional Medical Center for his minor injuries. A forced bold test was taken and, as stated in the arrest affidavit, “The results of the blood tests showed that Goodman had a blood alcohol level of .177.”

Goodman was arrested on charges of DUI manslaughter and vehicular homicide, both with failure to render aid. If convicted, Goodman could face up to 30 years in prison for each charge. He has since been released on a 100,000 bail.

Our condolences are with all who have been affected by this tragedy.

Jermaine Nixon, a 15-year-old who is accused of running over and killing a Riviera Beach woman, has been charged as an adult and booked into the Palm Beach County jail at 10 p.m. on Thursday.

On March 19, Nixon lost control of a stolen 1997 silver Chevrolet Malibu and hit and killed Kathryn Veroxie, 21, who was walking near the intersection of Garden Road and Blue Heron Boulevard.

Kathryn Veroxie, known as “Kat,” moved to live with her aunt and uncle in Jupiter seven years ago after her mother died of breast cancer. Her father died the following year. She was attending Palm Beach State College and worked as a cashier at Publix. Veroxie, whose family states that she was autistic, was walking home to her new apartment following a date with her boyfriend.

Nixon, who fled the scene, was stopped by police a short distance away. Nixon initially denied driving the vehicle and stated that the driver fled; however, he later surrendered to the Department of Juvenile Justice on May 1, after a warrant for his arrest was issued.
Deadly Delray Beach Boat Accident Proves to be Alcohol-Related

A late night boat ride in Delray Beach, which involved alcohol and speeding, resulted in a tragic Delray Beach boat accident.

On Saturday, May 8, at approximately 2 a.m., a boat driven by Mandy Romeu, 42, of Deerfield Beach crashed into a navigational marker in the Intracoastal Waterway. Passenger Christopher Smith, 31, of Boynton Beach was thrown from the boat into the canal, where he died, said investigators with the Florida Fish and Wildlife Conservation Commission.

According to police, Romeu met Christopher Smith and his sister, Alexandra Smith, at a nightclub on Friday night. After consuming many alcoholic drinks throughout the night, Romeu invited the Smiths to take a late night ride in his 35 foot boat.

This deadly boat ride involved the dangerous combination of alcohol intoxication and speeding. According to the FWC, Romeu admitted that he consumed “about four rum and cokes” from 7pm to midnight. He was also said to have been traveling at 30-40 miles per hour in an “idle speed zone.”

Romeu and Alexandra Smith were unharmed in the accident. Investigators state that none of those on board were wearing life jackets.

Romeu has been charged with vessel homicide, reckless operation of a vehicle and violation of navigational rules. Bond was set at $25,000 during a court appearance on Sunday.

Driving any vehicle while under the influence of alcohol or drugs can result in catastrophic consequences.
West Palm Beach Car Accident Involves Police Chase

A West Palm Beach car accident involving a stolen car and a police chase ends with a suspect hospitalized. The incident began in Boynton Beach at approximately 10:45 AM on Friday morning, March 19, 2010.

According to reports, Boynton Beach police officer Stephen Maiorino spotted a stolen Honda Civic and gave chase. The driver of the stolen vehicle, 22-year-old Ivan Johnson, fled onto Interstate 95, after failing to pull over.

Johnson then exited Forest Hill Boulevard and finally came to a stop on Forest Court, a dead-end street. Both the Honda and the police cruiser caught on fire after the chase continued on foot.
Police believe that the Honda’s hot exhaust system may have led to the dry grass catching on fire. Unfortunately, the police cruiser was stopped too close to the Honda and caught on fire, as well.

Maiorino was able to apprehend Johnson by tackling him to the ground. Rescue crews transported the suspect to St. Mary’s Medical Center after complaining of injuries.

Maiorino also complained of a hand injury. He went to a nearby walk-in clinic.

Johnson’s passenger, 18-year-old Patrick McIntosh, was able to flee the accident scene. He was arrested a short time later by West Palm Beach Police officers.

We wish Officer Maiorino a speedy recovery.
