5 Ways Trucking Companies Avoid Liability in Lake Worth Truck Accidents

You’ve just filed an insurance claim after a Lake Worth truck accident. A few days later, you get a phone call from an insurance adjuster telling you that your claim has been denied-because YOU caused the accident. You can’t believe it-how can YOU have caused an accident with a big rig?

Trucking companies know that their vehicles are more likely to be involved in road accidents. They have prepared for these crashes a number of ways: huge insurance policies, armies of attorneys, and coaching their drivers on exactly what to say if they’re involved in an accident. By controlling the conversation after a wreck, the truck driver can collect information from the motorist while buying time for the company’s insurance adjusters to arrive-who then take pictures and statements to use as evidence against the motorist.

To avoid liability, a trucking company may claim that you:

  • Weren’t paying attention. The company’s lawyer may ask you whether you were tired, stressed, or otherwise distracted during the accident in an attempt to make you admit fault.
Weren’t obeying traffic laws. If you failed to perform all necessary driving tasks, such as stopping at red lights or using your signals, the trucking company’s attorney could use that as evidence of negligent driving.
Were speeding. If you showed signs of risky behavior prior to the accident, such as speeding or weaving in and out of traffic lanes, the trucking company may claim that you were more at fault in the crash.
Would have crashed anyway. A common defense in trucking cases is that the driver’s actions-talking on a cell phone, driving without his glasses-would have eventually caused an accident whether the truck was there or not.
Already admitted fault. Saying anything remorseful after a crash, such as a simple “I’m sorry”-it could be used against you later. If you signed any documents after the accident, it may be even harder to prove your innocence

As experienced Lake Worth semi accident attorneys, we have seen too many innocent drivers become victims of their own words. Drivers trying to make the best of a terrible situation are often taken advantage of in court, and denied insurance payouts that are rightfully theirs.
